Description

This is 1 of 59 Foals that My 75% Horse Trickey Trevor sired. I was 75% owner of Trickey Trevor and I never received $0.01 for any of His Stud fees, however I was sued for about $10,000 from Victory Rose for breeding the Horse and others. The published Stud fee was $5,000 for each live foal and the fee was later reduced.

Here is how it all started. One day My Driver, the late Mr. Philip Beberian, made a suggestion that I start buying race horses. He had experience working with Horse trainers when He was in His teens at Philadelphia Park Race Track. He loved going to the Track, He started going there with His Father at about 8 years old. He suggested that I hire Jerry Hollendorfer, the leading trainer at Bay Meadows and Golden Gate Racetrack. So I made a 14k Gold Horse Head Ring and Phil and I went up to Bay Meadows and I walked up to Jerry and introduced Myself and gave Him the Ring as a gift.

I told Him that I was interested in buying a Horse. He gave Me His Phone Number and I called Him a few days later. He told Me about a Roar Filly by the name of She is Grrreat that I could buy 25% of for about $20,000, meaning the Horse had a 100% value of about $80,000. So I said I am in. At the time I did not know very much about the breeding and prices of Horses. I now know today that 100% of that old broken down nag that He sold Me was not worth $20k and that is putting it nicely. I waited and waited for She is Grrreat to run and months and months passed by. Finally one day, the good news came in that She was going to run at Bay Meadows. Jerry brought her out to the starting gate and then scratched Her. He said that she had a problem with Her knee. Then My then Wife and kids were scheduled to fly to Rome for My Friend Levon Zekian's Wedding. We went out for dinner a while before and the kids were running around and making noise and I said these kids are not ready to travel to Italy. So We went to Disneyland instead. Phil asked Me if He could go talk to Jerry about the Horse and I said Yes on 1 condition, that You do not ask Him for the money back. He said He understood and He went to meet with Jerry. Phil Loved the Horses, He loved being around them, He especially Loved betting on them. So He goes and sits down with Jerry Hollendorfer and looks Him right in the eyes and tells Him, Look Jerry, let Me tell You something about Dan, He is Your best friend. You say that the Horse has a bad knee, We know about knees Jerry. Now what Phil was talking about was when He used to work at Philadelphia Park, and He knew about when they would ice a Horses knee. So Jerry hears this and says to Phil, does Dan want His Money back? And Phil answered Yes He does.

So Jerry calls Me on the Phone and I tell Him I don't want My Money back. I told Him that I want to win with Him because I know that He was the best. So He said I have a package of 3 Horses, send Me $16k and We will be 50 50 partners and these are the kind that are ready to win. I said good and thank You.

Phil and I were in New York at the Jewelry Show and it was Halloween and the first of the 3 Horses was going to run named Woven Dream. It was a $4k race and My then Wife and Kids were there and the Horse won at the wire and it was the beginning. Then another Horse won. Then I started buying more and more partnerships with Jerry and a couple of Doctors from Washington, Dr. George Todaro and Dr. Mark Dedomenico, whose family sold Rice a Roni the San Francisco Treat.

One day Jerry called Me and I was in My then office in Fresno. He said there is a Horse running today by the name of Trickey Trevor, I used to have Him, He was hurt, had a surgery and now He is healed and running for $50,000 in a claiming race. Would You take 1/3? Yes. The Horse wins easy and I was thrilled. I called Jerry to thank Him and He said We lost the shake. This meant that other People put in a claim for Him before the Race and then they put numbered peas in a bottle and the one that comes out, owns Him, when there are multiple claims. I was very disappointed. I told Jerry go and offer a profit to the other guy and He said let's wait. Then one day Phil and I were in Florida at the Jewelry show and Jerry called Me and said do you remember that Horse that You wanted, He is running today in a $62,500 claiming race, will You take 75% and the Doctor Todaro and I will take the other 25%? I said Yes.

Phil and I went to Gulfstream Park to watch the race at the simulcast. Phil told everyone that would listen to bet on Trickey Trevor and He won easy and everyone was thrilled. Especially Me, there was another shake it showed on TV that We won the shake.

He then went on a Winning streak. Since I owned Him He earned about $400,000 more in earnings. His biggest win was on Kentucky Derby Day in 2006 at Churchill Downs, the Churchill Downs Handicap. He had North America's most winning Jockey on board Mr. Russell Baze. It was His first Win at Churchill Downs and My first win there.

One day I asked Jerry, can We run Trickey Trevor in the Sunshine Million? It was a race only for Florida and California bred Horses and He was a Florida bred. My whole Family went and My friends Ken and Jeannie Parnagian joined us at Santa Anita Racetrack. I am also friends with Dennis Parnagian. I have also known Varus Kardashian since I was in elementary school at Forkner. The Purse was $1,000,000 and I was 75% owner so if He would have won, I would have had a check for about $400,000 for my share. I did get about $400,000 in winnings from Trickey Trevor and others, but the training fees and vet bills, etc for all of the other Horses ate that Up.

It was a bit longer race, so the Horse had to pace himself to be there at the end to have the energy to win. Right out of the gate He went into a sprint and was used as a rabbit. I would have never known back then, Jerry told Me right after the race, that is why they call Jockeys Pin Heads. I believe that Jerry sold Me out that race for a guaranteed paycheck.

Then Jerry invited Me to go to the Auction and that is when We bought Bwana Bull for $140,000 and I was a 25% partner. Bwana Bull was a yearling and He was flown to My Partners Farm in Washington State called Pegasus. It was awesome. They have a row of Houses for vets and staff to take care of the Horses. They have a full size race track in the back yard and a swimming pool for the Horses with an underwater treadmill for them to work out and get built into top shape. When we went up to see Bwana Bull after about 1 year, He had grown so much and so strong. You could just tell by looking at Him, that this was an A grade Horse. His Father was Holy Bull that was owned by Sheikh Mohammed bin Rashid al Maktoum, the Ruler of Dubai.

I knew that Jerry had Derby fever. He still does to this day. The first time Bwana Bull ran He ran 3rd and was all over the track. Jerry said He saw potential in Him, He said He was like a big kid out playing. He had a few more races and then He won. Then He won 1st Place in the 2007 Calfornia Derby. Then He won the 2007 El Camino Real Derby. And He ran in the $2,000,000 Kentucky Derby. Sheikh Mohammed placed a double page ad in the global Horse Magazine saying that Bwana Bull was King because it would have been good for the Sire's demand to have a Foal that won the Kentucky Derby. He ran second in a photo finish in the $750,000 West Virginia Derby and the Illinois Derby. He was a Blessing of a Horse.

Then I introduced Jerry to My friends Dr. Kevin and Alberta Boran and We also bought Trickey Trevor's Brother, Show Me Your Money, who won a race beautifully and We had high hopes for Him, then one day we got a call, Jerry said during a workout He snapped His ankle and they had to put Him to sleep. I felt bad because I was sad when this horse that was going to be a money maker died, and when the other horse died that was a nag that just ran up vet bills, I had no emotional attachment. I did enjoy going into the barn feeding carrots to My Horses and petting them and speaking nicely to them. One time I was very happy and I decided to give the horse a big hug, like the way that You would hug a human. I wrapped My arms around the horse and she gently bit me on my clavicle and I jumped like a jackrabbit.

One day I called Jerry and said I am done, can I come up and pick up a check. He said ok I can give You $60,000. So I went up there and He wrote Me a check. I later asked Him, was that for all of My about 26 Horse Partnerships? He answered "No".

I do not know if part was for an insurance settlement that I did not know about, a sale, or what it was for. I have asked Him over the years to clarify and He has not.

My bill with the breeder Victory Rose was about $10k that She sued Me for. I spoke to the broker that handled the sale of Bwana Bull to a Mayor in The Philippines and I was told that 100% of My Proceeds went to pay Victory Rose so I should owe Her nothing. Now the Question is why should I not have collected the documented Stud fees as they were coming in from My 75% Owned Horse and been notified of any insurance claim settled in my behalf?
